Paqja, m\u00ebshira dhe begatit\u00eb e Allahut qofshin mbi Muhamedin m\u00ebsuesin e njer\u00ebzis\u00eb.<\/p>\n<p>Qysh her\u00ebt flitet p\u00ebr gruan, p\u00ebr gjendjen e saj, vuajtjet, mjerimet q\u00eb i ka p\u00ebrjetuar ajo n\u00eb etapat m\u00eb t\u00eb zeza t\u00eb shoq\u00ebrive injorante. Mizoria ndaj saj kaloi \u00e7do kufi aq sa u ngrit pyetja se: A \u00ebsht\u00eb gruaja njeri apo jo?!&#8230; Kjo gjendje vazhdoi k\u00ebshtu deri me ardhjen e Islamit. Islami i jep gruas nj\u00eb jet\u00eb t\u00eb re, si vajz\u00eb, fem\u00ebr, n\u00ebn\u00eb, grua, gjyshe; \u00e7ka do t\u00eb thot\u00eb q\u00eb nga lindja e deri n\u00eb vdekje.<\/p>\n<p>Allahu e ngriti femr\u00ebn dhe i dha t\u00eb drejtat e saj. N\u00eb Kuran \u00ebsht\u00eb surja \u201cNisa\u201d kaptina e \u201cGruas\u201d dhe pik\u00ebrisht n\u00eb k\u00ebt\u00eb sure jan\u00eb vendosur ajetet e trash\u00ebgimis\u00eb dhe i futi t\u00eb drejtat e saj n\u00eb t\u00eb gjitha poret e jet\u00ebs e ajo q\u00eb la p\u00ebrshtypje m\u00eb t\u00eb madhe dhe vulosi drejt\u00ebsin\u00eb e Islamit \u00ebsht\u00eb edhe e drejta e trash\u00ebgimis\u00eb s\u00eb femr\u00ebs n\u00eb Islam. Orientalist\u00eb t\u00eb ndrysh\u00ebm kur mor\u00ebn hov p\u00ebr ta sulmuar Islamin filluan ta sulmojn\u00eb\u00a0 n\u00ebp\u00ebrmes femr\u00ebs, me pretekstin se Islami nuk i ka dh\u00ebn\u00eb t\u00eb drejta femr\u00ebs dhe ka b\u00ebr\u00eb q\u00eb mashkulli t\u00eb marr\u00eb dy hise e femra nj\u00eb. E gjith\u00eb kjo vjen si pasoj\u00eb e mosnjohjes s\u00eb dispozitave t\u00eb trash\u00ebgimis\u00eb islame. N\u00eb k\u00ebt\u00eb kurth shpesh her\u00eb kan\u00eb r\u00ebn\u00eb viktim\u00eb edhe disa pjes\u00ebtar t\u00eb fes\u00eb islame. Ne kemi sjell\u00eb nj\u00eb version t\u00eb shkurtuar t\u00eb disa dispozitave, edhe pse kjo shkenc\u00eb \u201cshkenca e trash\u00ebgimis\u00eb n\u00eb islam\u201d \u00ebsht\u00eb nj\u00eb fush\u00eb e gjer\u00eb.<\/p>\n<p><strong>Disa nga ajetet kuranore t\u00eb trash\u00ebgimis\u00eb: <\/strong><\/p>\n<p>Allahu i Madh\u00ebruar thot\u00eb:<\/p>\n<p><strong><em>\u201cAllahu ju urdh\u00ebron p\u00ebr<\/em><\/strong> (\u00e7\u00ebshtjen e trash\u00ebgimit)<strong> <em>f\u00ebmij\u00ebt tuaj: p\u00ebr mashkullin hise sa p\u00ebr dy femra; n\u00ebse jan\u00eb<\/em> <\/strong>(trash\u00ebgimtare)<strong> <em>vet\u00ebm femra, dy e m\u00eb shum\u00eb, atyre ju takojn\u00eb dy t\u00eb tretat e pasuris\u00eb q\u00eb trash\u00ebgohet; n\u00ebse \u00ebsht\u00eb nj\u00eb fem\u00ebr, asaj i takon gjysma <\/em><\/strong>Allahu i Madh\u00ebruar thot\u00eb:<\/p>\n<p><strong><em>\u201cJuve ju takon gjysma e asaj<\/em><\/strong> (pasurie)<strong> <em>q\u00eb l\u00ebn\u00eb grat\u00eb e tuaja, n\u00ebse ato nuk kan\u00eb f\u00ebmij\u00eb, por n\u00ebse ato kan\u00eb f\u00ebmij\u00eb juve ju takon nj\u00eb e kat\u00ebrta nga ajo q\u00eb l\u00ebn\u00eb ato, pasi t\u00eb kryhet testamenti i tyre dhe pasi t\u00eb lahet borxhi. Thuaju: &#8220;Allahu ju p\u00ebrgjigjet n\u00eb \u00e7\u00ebshtjen e &#8220;kelale-s&#8221;<\/em> <\/strong>(ai q\u00eb nuk ka prind\u00ebr dhe f\u00ebmij\u00eb q\u00eb ta trash\u00ebgojn\u00eb)<strong><em>.<\/em> <em>N\u00ebse vdes nj\u00eb njeri q\u00eb nuk ka f\u00ebmij\u00eb, por ka mot\u00ebr, at\u00ebher\u00eb asaj<\/em> <\/strong>(motr\u00ebs)<strong> <em>i takon gjysma e pasuris\u00eb s\u00eb l\u00ebn\u00eb. Ai<\/em> <\/strong>(v\u00ebllai)<strong> <em>trash\u00ebgon t\u00ebr\u00eb at\u00eb<\/em> <\/strong>(q\u00eb le motra)<strong> <em>n\u00ebse ajo nuk ka f\u00ebmij\u00eb. Allahu di p\u00ebr \u00e7do send.\u201d<\/em><\/strong><\/p>\n<p><strong>Hadithet e Pejgamberit sal-lallahu alejhi ue selem mbi trash\u00ebgimin\u00eb:<\/strong><\/p>\n<p>Pejgamberi <em>sal-lallahu alejhi ue selem<\/em> ka th\u00ebn\u00eb: <em>\u201cM\u00ebsoni \u201cel-feraid\u201d (trash\u00ebgimin\u00eb) dhe m\u00ebsojani t\u00eb tjer\u00ebve, sepse ajo \u00ebsht\u00eb gjysma e dituris\u00eb, ajo harrohet dhe e para gj\u00eb q\u00eb do t\u00eb ngrihet nga umeti im.\u201d<\/em><\/p>\n<p><strong>R\u00ebnd\u00ebsia e shkenc\u00ebs s\u00eb \u201cel-feraidit\u201d (trash\u00ebgimis\u00eb) tek dijetar\u00ebt musliman\u00eb:<\/strong><\/p>\n<p>Dijetar\u00ebt musliman\u00eb n\u00eb \u00e7do koh\u00eb i kan\u00eb dh\u00ebn\u00eb r\u00ebnd\u00ebsi k\u00ebsaj shkence duke shpenzuar koh\u00eb dhe mund n\u00eb m\u00ebsimin dhe interpretimin e k\u00ebsaj shkence tek gjeneratat e reja. Ata kan\u00eb shkruar libra dhe ende shkruhen t\u00eb till\u00eb nga dijetar\u00ebt bashk\u00ebkohor\u00eb. Omeri Allahu qoft\u00eb i k\u00ebnaqur prej tij thot\u00eb: <em>\u201cM\u00ebsoni feraidin-shkenc\u00ebn e trash\u00ebgimis\u00eb, se ajo \u00ebsht\u00eb prej fes\u00eb suaj\u201d.<\/em><\/p>\n<p><strong><em>P\u00ebrkufizimi i Feraidit-\u00a0 trash\u00ebgimis\u00eb<\/em><\/strong><strong>:<\/strong><\/p>\n<p><strong>Aspekti gjuh\u00ebsor: <\/strong>\u201cFeraid\u201d \u00ebsht\u00eb e marr\u00eb nga fjala \u201cfard\u201d, q\u00eb ka disa kuptime: \u201ckat\u2019a\u201d me pre,\u00a0 \u201ctekdijr\u201d p\u00ebrcaktim, \u201ctebjin\u201d sqarim.<\/p>\n<p><strong>Aspekti terminologjik: <\/strong><\/p>\n<p>Shkenca, e cila mund\u00ebson se si t\u00eb ndahet pasuria atyre q\u00eb u takon.<\/p>\n<p>Shkenca, e cila mund\u00ebson t\u00eb dihet, se kush ka t\u00eb drejt\u00eb trash\u00ebgimie apo jo dhe sasin\u00eb se sa i takon \u00e7do trash\u00ebgimtari.<\/p>\n<p><strong>Trash\u00ebgimia e femr\u00ebs para Islamit:<\/strong><\/p>\n<p><strong>Trash\u00ebgimia tek \u00e7ifut\u00ebt <\/strong><\/p>\n<p>Ligji i \u00e7ifut\u00ebve p\u00ebr trash\u00ebgimin\u00eb e femr\u00ebs dallohet p\u00ebr at\u00eb se ata e privojn\u00eb femr\u00ebn nga trash\u00ebgimia, pa marr\u00eb parasysh n\u00ebse \u00ebsht\u00eb ajo n\u00ebn\u00eb, mot\u00ebr, vajz\u00eb apo nga ato q\u00eb kan\u00eb t\u00eb drejt\u00eb trash\u00ebgimie p\u00ebrve\u00e7 n\u00ebse nuk ka mashkull trash\u00ebgues. Vajza nuk ka t\u00eb drejt\u00eb trash\u00ebgimie p\u00ebrve\u00e7 n\u00eb munges\u00eb t\u00eb mashkullit, at\u00ebher\u00eb ajo e fiton k\u00ebt\u00eb t\u00eb drejt\u00eb. Nd\u00ebrsa gruaja nuk trash\u00ebgon nga burri i saj asgj\u00eb.<\/p>\n<p><strong>Trash\u00ebgimia e femr\u00ebs tek romak\u00ebt e vjet\u00ebr:<\/strong><\/p>\n<p>Femra tek romak\u00ebt e vjet\u00ebr kishte t\u00eb drejt\u00eb trash\u00ebgimie t\u00eb nj\u00ebjt\u00eb me mashkullin, p\u00ebrve\u00e7 bashk\u00ebshortes, e cila nuk kishte t\u00eb drejt\u00eb t\u00eb trash\u00ebgoj\u00eb nga burri i saj, sepse lidhja martesore nuk llogaritej nga shkaqet q\u00eb ua lejojn\u00eb femr\u00ebs t\u00eb trash\u00ebgoj\u00eb nga burri i saj. Arsyeja ishte q\u00eb mos t\u00eb transferohet pasuria tek nj\u00eb familje tjet\u00ebr. N\u00ebse pasuria e trash\u00ebguar b\u00ebn pjes\u00eb nga thesaret q\u00eb nuk shkartohen, at\u00ebher\u00eb n\u00ebse vdes n\u00ebna pasurin\u00eb q\u00eb e ka trash\u00ebguar nga babi i saj e trash\u00ebgon motra e saj e jo f\u00ebmij\u00ebt e saj, edhe pse ajo mund t\u00eb ket\u00eb l\u00ebn\u00eb f\u00ebmij\u00eb djem apo vajza.<\/p>\n<p><strong>Trash\u00ebgimia e femr\u00ebs tek popujt e lindjes:<\/strong><\/p>\n<p>Me popujt e lindjes kemi si q\u00ebllim t\u00eb gjith\u00eb ata popuj q\u00eb kan\u00eb jetuar n\u00eb Lindje pas tufanit dhe para lindjes s\u00eb Isait <em>alejhi selam<\/em>. Sistemi i trash\u00ebgimis\u00eb ka qen\u00eb i vendosur n\u00eb at\u00eb se v\u00ebllai i madh e z\u00ebvend\u00ebson baban\u00eb e n\u00ebse nuk ka, pastaj v\u00ebllez\u00ebrit, xhaxhallar\u00ebt, e k\u00ebshtu me radh\u00eb deri tek nipat dhe t\u00eb af\u00ebrmit.<\/p>\n<p><strong>Trash\u00ebgimia tek egjiptian\u00ebt e vjet\u00ebr:<\/strong><\/p>\n<p>Tek egjiptian\u00ebt e vjet\u00ebr d\u00ebshmit\u00eb tregojn\u00eb se sistemi i trash\u00ebgimis\u00eb ka qen\u00eb i vendosur se t\u00eb gjith\u00eb t\u00eb af\u00ebrmit e t\u00eb vdekurit kan\u00eb t\u00eb drejt\u00eb trash\u00ebgimie nj\u00ebsoj, pa marr\u00eb parasysh n\u00ebse \u00ebsht\u00eb mashkull apo fem\u00ebr, i madh apo i vog\u00ebl .<\/p>\n<p><strong>Trash\u00ebgimia e femr\u00ebs tek arab\u00ebt para Islamit: <\/strong><\/p>\n<p>Mund t\u00eb themi se tek arab\u00ebt para-islamit nuk ka pasur ndonj\u00eb sistem t\u00eb ve\u00e7ant\u00eb trash\u00ebgimie, por ata n\u00eb k\u00ebt\u00eb fush\u00eb kan\u00eb ndjekur popujt e lindjes. Trash\u00ebgimia ka qen\u00eb e ve\u00e7ant\u00eb p\u00ebr meshkujt, t\u00eb cil\u00ebt kan\u00eb qen\u00eb t\u00eb gatsh\u00ebm p\u00ebr mbajtjen e arm\u00ebve q\u00eb t\u00eb p\u00ebrballen me armikun, nd\u00ebrsa t\u00eb vegjlit dhe grat\u00eb nuk b\u00ebjn\u00eb pjes\u00eb k\u00ebtu.<\/p>\n<p><strong>Trash\u00ebgimia e femr\u00ebs n\u00eb Islam <\/strong><\/p>\n<p>Pasi shpalos\u00ebm k\u00ebtu periudh\u00ebn e err\u00ebt, se si ishte gjendja e femr\u00ebs p\u00ebrball\u00eb trash\u00ebgimis\u00eb dhe pam\u00eb se \u00e7far\u00eb mizorish i b\u00ebheshin asaj n\u00eb ato ligje dhe sisteme t\u00eb gabuara, ku epshi dhe nefsi luanin nj\u00eb rol t\u00eb madh do t\u00eb shohim tashm\u00eb periudh\u00ebn islame. Islami erdhi me drit\u00ebn dhe drejt\u00ebsin\u00eb e tij p\u00ebr ta ngritur femr\u00ebn nga padrejt\u00ebsia dhe ulja, q\u00eb i kishin b\u00ebr\u00eb asaj dhe p\u00ebr t\u00eb konfirmuar, se edhe ajo \u00ebsht\u00eb njeri sikurse mashkulli. Ajo ka t\u00eb drejtat e saj, q\u00eb askush nuk ka t\u00eb drejt\u00eb p\u00ebr t\u2019ia mang\u00ebsuar ato, sikurse ajo ka edhe detyrime, q\u00eb nuk u lejohet t\u2019i anashkaloj\u00eb apo t\u2019i neglizhoj\u00eb ato.<\/p>\n<p><strong>Nj\u00eb pasqyr\u00eb e krahasimit mes Islamit dhe ligjeve, sistemeve t\u00eb trash\u00ebgimis\u00eb mbi femr\u00ebn:\u00a0\u00a0 <\/strong><\/p>\n<p>Ai q\u00eb ka marr\u00eb p\u00ebrsip\u00ebr ndarjen e trash\u00ebgimis\u00eb n\u00eb Islam \u00ebsht\u00eb Krijuesi e jo krijesa, p\u00ebr k\u00ebt\u00eb arsye gjen sakt\u00ebsi dhe drejt\u00ebsi n\u00eb k\u00ebt\u00eb ndarje n\u00eb dobi t\u00eb gjith\u00eb njer\u00ebzimit<strong>. <\/strong>Allahu i Madh\u00ebruar thot\u00eb:<\/p>\n<p><strong><em>\u201c &#8230; ju nuk dini se kush \u00ebsht\u00eb m\u00eb af\u00ebr dobis\u00eb suaj, prind\u00ebrit tuaj apo f\u00ebmij\u00ebt tuaj.<\/em><\/strong> (Ky p\u00ebrcaktim \u00ebsht\u00eb)<strong> <em>Urdh\u00ebr nga Allahu. V\u00ebrtet Allahu \u00ebsht\u00eb m\u00eb i Dijshmi, m\u00eb i Urti.\u201d<\/em><\/strong><\/p>\n<p>Islami niset nga pik\u00ebpamja e nevoj\u00ebs, p\u00ebr at\u00eb i ka dh\u00ebn\u00eb atij q\u00eb ka nevoj\u00eb m\u00eb shum\u00eb, se sa atij q\u00eb nuk ka, p.sh., i ka dh\u00ebn\u00eb djalit m\u00eb shum\u00eb se bab\u00ebs, ngaq\u00eb nevoja e djalit \u00ebsht\u00eb m\u00eb e madhe, sepse ai e ka jet\u00ebn p\u00ebrpara, nd\u00ebrsa babai e len\u00eb jet\u00ebn mbrapa. Edhe n\u00eb rastin kur djali merr hise sa dy vajza, ngaq\u00eb nevoja e tij \u00ebsht\u00eb m\u00eb e madhe. Ai pritet t\u00eb martohet, t\u00eb jap\u00eb mehrin, shpenzimet q\u00eb ka ndaj gruas dhe familjes s\u00eb tij, nd\u00ebrsa vajza \u00ebsht\u00eb ajo q\u00eb do t\u00eb marr\u00eb dhe jo ajo q\u00eb do t\u00eb shpenzoj\u00eb.<\/p>\n<p>Islami e ka vler\u00ebsuar lidhjen martesore, ku ka b\u00ebr\u00eb q\u00eb kjo lidhje gjat\u00eb gjith\u00eb jet\u00ebs t\u00eb jet\u00eb shkak i trash\u00ebgimis\u00eb pas vdekjes. Ai nuk e ka anashkaluar, ashtu si\u00e7 ka ndodhur tek disa ligje apo sisteme t\u00eb lartp\u00ebrmendura.<\/p>\n<p>Islami nuk e ka anashkaluar \u00e7\u00ebshtjen e af\u00ebrsis\u00eb familjare, si shkak t\u00eb s\u00eb drejt\u00ebs s\u00eb trash\u00ebgimis\u00eb e si\u00e7 ka vepruar sistemi romak dhe ai i grek\u00ebve. Por lidhja e af\u00ebrsis\u00eb familjare \u00ebsht\u00eb ajo q\u00eb njeriu forcohet me t\u00eb n\u00eb k\u00ebt\u00eb jet\u00eb, mundohet t\u00eb jap\u00eb kontributin m\u00eb t\u00eb madh p\u00ebr ta, t\u2019i dal\u00eb n\u00eb ndihm\u00eb dhe p\u00ebrkujdesje.<\/p>\n<p>Barazia mes t\u00eb af\u00ebrmve n\u00eb trash\u00ebgimi, ashtu si\u00e7 vepronin egjiptian\u00ebt e vjet\u00ebr. K\u00ebtu ka padrejt\u00ebsi mbi femr\u00ebn, ngase vet\u00eb dalja e saj nga sht\u00ebpia p\u00ebr pun\u00eb e ve p\u00ebrball\u00eb me shum\u00eb sfida dhe p\u00ebr k\u00ebt\u00eb ka shum\u00eb d\u00ebshmi.<\/li>\n<li>Ndarja e trash\u00ebgimis\u00eb n\u00eb ligjin islam nuk b\u00ebhet p\u00ebr shkak t\u00eb burr\u00ebris\u00eb apo feminitetit, por p\u00ebr shkak t\u00eb detyrave q\u00eb ka secili. Gjithashtu merret n\u00eb konsiderat\u00eb edhe nevoja e trash\u00ebgimtarit, lloji i lidhjes nd\u00ebrmjet tij dhe pasardh\u00ebsve. Pra, \u00e7\u00ebshtja \u00ebsht\u00eb absolutisht ekonomike.<\/li>\n<li>Situatat n\u00eb t\u00eb cilat ligji islam i ka dh\u00ebn\u00eb m\u00eb tep\u00ebr mashkullit sesa femr\u00ebs nuk jan\u00eb thjesht pa dobi, por p\u00ebr shkak t\u00eb pozit\u00ebs s\u00eb tij p\u00ebr sa i p\u00ebrket shpenzimit familjar. S\u2019ka dyshim se n\u00eb k\u00ebt\u00eb sistem ka padrejt\u00ebsi, ngaq\u00eb ai nuk i merr parasysh detyrat individuale p\u00ebr t\u00eb dy gjinit\u00eb.<\/li>\n<\/ul>\n<p>Trash\u00ebgimia \u00ebsht\u00eb \u00e7\u00ebshtje llogarie e jo \u00e7\u00ebshtje ndjenjash e pretendimesh. Femra merr nj\u00eb t\u00eb tret\u00ebn q\u00eb t\u00eb shpenzoj\u00eb vet\u00ebm p\u00ebr veten e saj, kurse mashkulli dy t\u00eb tretat q\u00eb t\u00eb shpenzoj\u00eb fillimisht p\u00ebr bashk\u00ebshorten (grua), pastaj p\u00ebr familjen dhe f\u00ebmij\u00ebt e tij. Pra, kush merr m\u00eb tep\u00ebr me logjik\u00ebn e llogaritjes dhe logjik\u00ebn e numrave? Gjysma e asaj q\u00eb merr mashkulli m\u00eb tep\u00ebr se femra n\u00eb disa raste \u00ebsht\u00eb thelbi i drejt\u00ebsis\u00eb, ngase pasuria e mashkullit do t\u00eb pak\u00ebsohet p\u00ebrmes mehrit dhe shpenzimeve familjare, nd\u00ebrsa pasuria e saj do t\u00eb rritet me mehr dhe investim, n\u00ebse ajo investon. Shumica e vendeve skandinave akoma vazhdojn\u00eb t\u00eb b\u00ebjn\u00eb dallim n\u00eb trash\u00ebgimi nd\u00ebrmjet mashkullit dhe femr\u00ebs. Islami e kund\u00ebrshton edhe parimin e barazis\u00eb absolute nd\u00ebrmjet asaj dhe mashkullit n\u00eb trash\u00ebgimi. Ai n\u00eb k\u00ebt\u00eb drejtim ka v\u00ebn\u00eb rregulla prej t\u00eb cilave nuk duhet t\u00eb dalim.
