Duke u nisur nga ky parim muslimani duhet t\u00eb ket\u00eb n\u00eb konsiderat\u00eb se si po e fiton pasurin\u00eb, p\u00ebr shkak se p\u00ebrfitimi i pasuris\u00eb haram \u00ebsht\u00eb shkaktar p\u00ebr pengimin e shum\u00eb mir\u00ebsive q\u00eb nuk mund t\u2019i arrijn\u00eb njeriut.<\/p>\n<p>Muslimi ka sh\u00ebnuar hadithin e Ebu Hurejr\u00ebs, Allahu qoft\u00eb i k\u00ebnaqur me t\u00eb, se ka th\u00ebn\u00eb: Pejgamberi sal-lallahu alejhi ue selem ka th\u00ebn\u00eb: \u201cO ju njer\u00ebz! Me t\u00eb v\u00ebrtet\u00eb Allahu \u00ebsht\u00eb i Bukur dhe pranon vet\u00ebm t\u00eb bukur\u00ebn. Me t\u00eb v\u00ebrtet\u00eb Allahu i ka urdh\u00ebruar besimtar\u00ebt me at\u00eb q\u00eb i ka urdh\u00ebruar Pejgamber\u00ebt dhe ka Th\u00ebn\u00eb:<\/p>\n<p>\u201cO ju q\u00eb besuat, hani nga t\u00eb mirat q\u00eb ua kemi dh\u00ebn\u00eb dhe fal\u00ebnderoni Allahun, n\u00ebse jeni q\u00eb vet\u00ebm At\u00eb e adhuroni.\u201d[1]&#8230;.<\/p>\n<p>Nga shenjat e k\u00ebsaj kohe p\u00ebrfitimet e paligjshme \u00ebsht\u00eb ajo q\u00eb na ka paralajm\u00ebruar Pejgamberi sal-lallahu alejhi ue selem, se do t\u00eb ndodhin. Sh\u00ebnon Buhariu hadithin e Seid Makberiut nga Ebu Hurejra, Allahu qoft\u00eb i k\u00ebnaqur prej tij, se Pejgamberi sal-lallahu alejhu ue selem ka th\u00ebn\u00eb: \u201cDo t\u00eb vij\u00eb nj\u00eb koh\u00eb kur njer\u00ebzit nuk do t\u00eb shikojn\u00eb se nga e p\u00ebrfitojn\u00eb pasurin\u00eb nga hallalli apo harami.\u201d<\/p>\n<p>Realiteti i p\u00ebrfitimeve t\u00eb paligjshme:<\/p>\n<p>P\u00ebrfitimi i paligjsh\u00ebm \u00ebsht\u00eb: \u201cPasuri e cila \u00ebsht\u00eb arritur apo mbledhur n\u00ebp\u00ebrmjet rrug\u00ebve jo t\u00eb ligjshme n\u00eb sheriatin islam.\u201d<\/p>\n<p>Arritja tek p\u00ebrfitimet e ndaluara ndodh p\u00ebrmes shum\u00eb rrug\u00ebve, por ne do t\u00eb cekim dy rrug\u00eb kryesore n\u00ebp\u00ebrmjet t\u00eb cilave arrihet pasuria e ndaluar.<\/p>\n<p>Rruga e par\u00eb: Pasuria t\u00eb jet\u00eb arritur pa p\u00eblqim. P\u00ebrfitimet t\u00eb cilat jan\u00eb mbledhur jan\u00eb bartur nga pronari tek personi n\u00eb fjal\u00eb pa p\u00eblqimin e pronarit si: Vjedhja, uzurpimi, mashtrimet.<\/p>\n<p>Rruga e dyt\u00eb:\u00a0 Pasuria t\u00eb jet\u00eb arritur me p\u00eblqimin e dy pal\u00ebve. P\u00ebrfitimet t\u00eb cilat i ka marr\u00eb jan\u00eb bartur nga pronari tek personi n\u00eb fjal\u00eb me p\u00eblqim, si rezultat i kontratave t\u00eb paligjshme, si: kamata, bixhozi, shitblerja e alkoolit, substancave narkotike apo p\u00ebrfitimet nga imoraliteti, magjia, korrupsioni etj.<\/p>\n<p>Tani do t\u00eb sjellim sqarimin e dy rrug\u00ebve t\u00eb lartp\u00ebrmendura.<\/p>\n<p>1)\u00a0\u00a0\u00a0 P\u00ebrfitimet e paligjshme t\u00eb arritura pa p\u00eblqimin e pal\u00ebve:<\/p>\n<p>Pron\u00ebsia e pasuris\u00eb n\u00eb k\u00ebto lloje t\u00eb p\u00ebrfitimeve kujt i takon?<\/p>\n<p>N\u00eb esenc\u00eb k\u00ebto p\u00ebrfitime mbesin n\u00eb pron\u00ebsi t\u00eb pronar\u00ebve t\u00eb tyre. Por kjo mund t\u00eb ndryshoj\u00eb n\u00eb rast se (pasuris\u00eb s\u00eb arritur pa p\u00eblqimin e pal\u00ebve) mund t\u2019i ndodh\u00eb shtimi apo mang\u00ebsimi. Ky ndryshim mund t\u00eb jet\u00eb tre llojesh<\/p>\n<ol>\n<li>a) P\u00ebrfitimet e ndaluara q\u00eb kan\u00eb mbetur pa ndryshuar:<\/li>\n<\/ol>\n<p>Nuk ka mospajtim mes dijetar\u00ebve se prona e k\u00ebtyre p\u00ebrfitimeve t\u00eb paligjshme\u00a0 i takon pronar\u00ebve t\u00eb tyre dhe ai i cili ua ka marr\u00eb e ka p\u00ebr detyr\u00eb q\u00eb t\u2019ia kthej\u00eb k\u00ebt\u00eb pasuri, n\u00ebse dihet pronari i tyre dhe nuk jan\u00eb p\u00ebrjetuar shtim apo mang\u00ebsim.<\/p>\n<p>Ib\u00ebn Ubejre thot\u00eb: \u201cDijetar\u00ebt kan\u00eb r\u00ebn\u00eb n\u00eb p\u00eblqim, se uzurpuesi \u00ebsht\u00eb i detyruar ta kthej\u00eb pasurin\u00eb e uzurpuar n\u00ebse pasuria ekziston dhe nuk frik\u00ebsohet se ky kthim mund t\u00eb shkaktoj\u00eb mbytjen e ndonj\u00eb personi.<\/p>\n<ol>\n<li>b) P\u00ebrfitimet e ndaluara q\u00eb kan\u00eb mbetur, por jan\u00eb d\u00ebmtuar<\/li>\n<\/ol>\n<p>N\u00ebse k\u00ebto p\u00ebrfitime t\u00eb ndaluara jan\u00eb shkat\u00ebrruar n\u00eb t\u00ebr\u00ebsi dhe nuk ka mund\u00ebsi t\u2019i kthehet pronarit t\u00eb saj, dispozita e saj ndryshon n\u00eb baz\u00eb t\u00eb gjendjes. N\u00eb k\u00ebt\u00eb rast nuk mund t\u00eb dal\u00eb nga dy gjendje:<\/p>\n<p>Gjendja e par\u00eb: Q\u00eb k\u00ebto p\u00ebrfitime t\u00eb ndaluara t\u00eb jen\u00eb t\u00eb llojit t\u00eb ngjash\u00ebm. N\u00eb k\u00ebt\u00eb rast obligohet t\u2019ia kthej\u00eb me po t\u00eb nj\u00ebjtin lloj t\u00eb ngjash\u00ebm.<\/p>\n<p>Gjendja e dyt\u00eb: Q\u00eb k\u00ebto p\u00ebrfitime t\u00eb ndaluara t\u00eb jen\u00eb n\u00eb sasi. N\u00eb k\u00ebt\u00eb rast obligohet q\u00eb p\u00ebrfituesi\u00a0 ta kthej\u00eb (pasurin\u00eb) sasin\u00eb. N\u00eb k\u00ebt\u00eb rast kat\u00ebr imam\u00ebt jan\u00eb pajtuar.<\/p>\n<ol>\n<li>c) P\u00ebrfitimet e paligjshme q\u00eb kan\u00eb ndryshuar:<\/li>\n<\/ol>\n<p>Prona n\u00eb k\u00ebt\u00eb rast ndikohet var\u00ebsisht nga lloji i ndryshimit. K\u00ebto ndryshime mund t\u00eb jen\u00eb, ose n\u00eb p\u00ebrgjith\u00ebsi q\u00eb kan\u00eb ndryshuar, ose pjes\u00ebrisht n\u00eb shtim, ose pak\u00ebsim.<\/p>\n<p>&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Ndryshimi i p\u00ebrgjithsh\u00ebm:\u00a0 Shembull: N\u00ebse dikush ka vjedhur hekur apo dru dhe k\u00ebt\u00eb material e ka futur n\u00eb nd\u00ebrtim. N\u00eb k\u00ebt\u00eb rast prona e k\u00ebtyre p\u00ebrfitimeve t\u00eb ndaluara i takon pronarit t\u00eb saj dhe pronari \u00ebsht\u00eb i lir\u00eb t\u00eb p\u00ebrzgjedh\u00eb n\u00eb mes marrjes dhe plot\u00ebsimin e mang\u00ebsis\u00eb, ose n\u00eb mes k\u00ebrkimit me z\u00ebvend\u00ebsim t\u00eb atij ndryshimi q\u00eb ka ndodhur\u00a0 pa marr\u00eb parasysh se ky ndryshim ka ndodhur me teprim apo mang\u00ebsim, ose me di\u00e7ka tjet\u00ebr. Problemi q\u00ebndron se p\u00ebrfituesi nuk ka dor\u00eb t\u00eb sigurt dhe ai n\u00eb t\u00eb gjitha gjendjet duhet t\u00eb kompensoj\u00eb.<\/p>\n<p>&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Ndryshimi me pak\u00ebsim: Ky lloj ndryshimi nuk ndikon n\u00eb pron\u00ebn e pronarit t\u00eb saj, kjo i takon atij dhe pjesa e pak\u00ebsuar i kompensohet.<\/p>\n<p>&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Ndryshimet me shtim: Ky ndryshim nuk ndikon n\u00eb heqjen e pron\u00ebs nga dora e pronarit t\u00eb saj.<\/p>\n<p>Fitimet nga k\u00ebto lloje p\u00ebrfitimesh t\u00eb paligjshme<\/p>\n<p>Dijetar\u00ebt kan\u00eb r\u00ebn\u00eb n\u00eb mospajtim se fitimet e k\u00ebtyre p\u00ebrfitimeve t\u00eb paligjshme t\u00eb arritura pa p\u00eblqimin e pal\u00ebve n\u00eb pron\u00ebn e kujt hyjn\u00eb.<\/p>\n<p>Nga mendimet e tyre shihet se m\u00eb i sakt\u00eb \u00ebsht\u00eb mendimi, se k\u00ebto fitime q\u00eb kan\u00eb ardhur nga puna e p\u00ebrfituesit ky \u00ebsht\u00eb ortak me pronarin n\u00eb k\u00ebto fitime. Ky \u00ebsht\u00eb nj\u00eb transmetim nga imam Ahmedi dhe k\u00ebt\u00eb mendim e mb\u00ebshtet Ib\u00ebn Tejmije dhe Ib\u00ebn Kajimi dhe kjo \u00ebsht\u00eb p\u00ebrzgjedhja me t\u00eb cil\u00ebn ka punuar kalifi Omer bin Hatab Allahu qoft\u00eb i k\u00ebnaqur me t\u00eb, dhe jan\u00eb pajtuar shok\u00ebt e Pejgamberit sal-lallahua lejhi ue selem. N\u00eb k\u00ebt\u00eb ka drejt\u00ebsi sepse shtimi apo fitimi ka ndodhur nga puna e k\u00ebtij (uzurpuesit) dhe pasuria e pronarit nuk i takon vet\u00ebm pronarit n\u00eb k\u00ebt\u00eb rast q\u00eb nj\u00ebri t\u00eb dallohet me fitim nga tjetri dhe nuk ka nevoj\u00eb t\u00eb jepet sadaka fitimi, si\u00e7 \u00ebsht\u00eb edhe nj\u00ebri nd\u00ebr mendimet e dijetar\u00ebve.<\/p>\n<p>Fitimi i takon n\u00eb k\u00ebt\u00eb rast t\u00eb dy pal\u00ebve sikur t\u00eb ishin n\u00eb nj\u00eb biznes ortak.<\/p>\n<p>Pendimi nga ky lloj i p\u00ebrfitimeve t\u00eb ndaluara<\/p>\n<ol>\n<li>a) Pendimi me mund\u00ebsin\u00eb e kthimit tek pronari<\/li>\n<\/ol>\n<p>N\u00ebse ka mund\u00ebsi q\u00eb k\u00ebto p\u00ebrfitime t\u00eb ndaluara pa p\u00eblqimin e pal\u00ebve t\u00eb kthehen tek pronar\u00ebt e tyre nuk ka mospajtim, se pendimi nuk realizohet e as q\u00eb largohet nga m\u00ebkati n\u00eb fjal\u00eb p\u00ebrve\u00e7 me kthimin e pasuris\u00eb tek pronari i saj.<\/p>\n<p>Argument \u00ebsht\u00eb hadithi, t\u00eb cilin e sh\u00ebnon imam Ahmedi dhe Ebu Davudi nga hadithi i Saib bin Jezidit, nga babai i tij, nga gjyshi i tij, nga Pejgamberi sal-lallahu alejhi ue selem, se ka th\u00ebn\u00eb: \u201cMos ta marr\u00eb askush nga ju mallin e shokut t\u00eb tij, duke luajtur apo seriozisht, e nese dikush nga ju e ka marr\u00eb shkopin e v\u00ebllait t\u00eb tij le t\u2019ia kthej\u00eb\u201d.<\/p>\n<ol>\n<li>b) Pendimi me pamund\u00ebsin\u00eb e kthimit tek pronari<\/li>\n<\/ol>\n<p>P\u00ebrfituesi nga p\u00ebrfitimet e ndaluara \u00ebsht\u00eb i detyruar q\u00eb t\u00eb pendohet dhe ai sipas xhumhurit t\u00eb dijetar\u00ebve \u00ebsht\u00eb i detyruar, q\u00eb nga p\u00ebrfitimet e ndaluara t\u00eb jap\u00eb l\u00ebmosh\u00eb n\u00eb interes t\u00eb musliman\u00ebve. Ai duhet q\u00eb t\u00eb b\u00ebj\u00eb p\u00ebrpjekjet maksimale, q\u00eb k\u00ebto shpenzime t\u2019i b\u00ebj\u00eb n\u00eb projekte sa m\u00eb t\u00eb dobishme dhe nuk plot\u00ebsohet pendimi pos n\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb.<\/p>\n<ol>\n<li>c) Kthimi i p\u00ebrfitimeve t\u00eb paligjshme tek trash\u00ebgimtar\u00ebt e pronarit t\u00eb saj<\/li>\n<\/ol>\n<p>Tek dijetar\u00ebt ekzistojn\u00eb dy mendime p\u00ebr ta larguar barr\u00ebn nga vetja n\u00eb kthimin e p\u00ebrfitimeve t\u00eb paligjshme tek trash\u00ebgimtar\u00ebt e pronarit.<\/p>\n<p>1)\u00a0\u00a0\u00a0 Mendimi i par\u00eb: P\u00ebrfituesi e largon barr\u00ebn n\u00eb k\u00ebt\u00eb bot\u00eb dhe bot\u00ebn tjet\u00ebr, n\u00ebse ua kthen qoft\u00eb edhe trash\u00ebgimtar\u00ebve t\u00eb pronarit p\u00ebrfitimet e paligjshme. Ky \u00ebsht\u00eb medhhebi i Ebu Hanifes, Shafive dhe Hanbelive.<\/p>\n<p>2)\u00a0\u00a0\u00a0 Mendimi i dyt\u00eb: P\u00ebrfituesi e largon barr\u00ebn e tij n\u00eb k\u00ebt\u00eb bot\u00eb e jo n\u00eb bot\u00ebn tjet\u00ebr.
