I lart\u00ebsuar qoft\u00eb Ai (Allahu), q\u00eb e b\u00ebri sinqeritetin dhe pasimin e Pejgamberit paqja dhe m\u00ebshira e Tij qofshin mbi te, kusht p\u00ebr t\u2019u pranuar veprat\u00a0 e mira. Koncepti i imanit tek Ehli Suneh uel Xhemaa \u00ebsht\u00eb: \u201cT\u00eb besuarit me zem\u00ebr, t\u00eb shqiptuarit me gjuh\u00eb, t\u00eb realizuarit n\u00eb vep\u00ebr\u201d.<\/p>\n<p>Nga ky koncept dalim n\u00eb p\u00ebrfundimin, se nuk plot\u00ebsohet besimi i besimtarit pa e realizuar at\u00eb me vepra. Vepra p\u00ebr t\u00eb qen\u00eb e pranuar duhet patjet\u00ebr t\u2019i plot\u00ebsoj dy kushte:<\/p>\n<ol>\n<li>a)\u00a0\u00a0\u00a0\u00a0\u00a0 sinqeriteti (nijeti).<\/li>\n<li>b)\u00a0\u00a0\u00a0\u00a0\u00a0 Pasimi i Sunetit t\u00eb Pejgamberit,\u00a0paqja dhe m\u00ebshira e Tij qofshin mbi te.<\/li>\n<\/ol>\n<p><strong>Definicioni i nijetit n\u00eb aspektin gjuh\u00ebsor:<\/strong><\/p>\n<p>Fjala nijet rrjedh nga fjala arabe nijeh, q\u00eb ka kuptim: q\u00ebllim, synim, vendosm\u00ebri, transformim, destinacion, vullnet.<a name=\"_ftnref1\"><\/a><a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a><\/p>\n<p><strong>Nijeti n\u00eb terminologjin\u00eb e fukahave:<\/strong><\/p>\n<p>Definicioni i hanefive. Ib\u00ebn Abidini thot\u00eb: \u201cSynimi i ibadetit\u00a0me q\u00ebllim af\u00ebrsie tek Allahu, q\u00eb krijon nj\u00eb vep\u00ebr.\u201d<\/p>\n<p><strong>Argumentet nga Kurani dhe Suneti:<\/strong><\/p>\n<p><strong><em>\u201cE duke qen\u00eb se ata nuk ishin t\u00eb urdh\u00ebruar me tjet\u00ebr, pos q\u00eb ta adhuronin Allahun me nj\u00eb adhurim t\u00eb sinqert\u00eb ndaj Tij, q\u00eb t\u00eb largohen prej \u00e7do besimi t\u00eb kot\u00eb&#8230;\u201d. <\/em><\/strong>(Bejineh:5)<\/p>\n<p>P\u00ebrcillet se prij\u00ebsi i besimtar\u00ebve Omer ib\u00ebn Hatabi ka th\u00ebn\u00eb: \u201cE kam d\u00ebgjuar t\u00eb D\u00ebrguarin e Allahut, paqja dhe m\u00ebshira e Tij qofshin mbi te, t\u00eb thot\u00eb: <em>\u201cT\u00eb gjitha veprat vler\u00ebsohen nga q\u00ebllimi<\/em> (nijeti)<em>, ndaj dhe \u00e7do person shp\u00ebrblehet sipas q\u00ebllimit t\u00eb tij&#8230;\u201d.<a href=\"#_ftn2\" name=\"_ftnref2\"><strong>[2]<\/strong><\/a><\/em><\/p>\n<p><strong>Kusht\u00ebzimi i nijetit :<\/strong><\/p>\n<p>Dijetar\u00ebt kan\u00eb r\u00ebn\u00eb n\u00eb p\u00eblqim, se veprat q\u00eb kryejn\u00eb besimtar\u00ebt p\u00ebr t\u00eb qen\u00eb t\u00eb pranuara n\u00eb sheriatin islam, apo p\u00ebr t\u00eb fituar shp\u00ebrblimin patjet\u00ebr duhet b\u00ebr\u00eb nijeti. T\u00eb gjitha shtyllat e Islamit, si namazi, agj\u00ebrimi, zekati, haxhi nuk jan\u00eb t\u00eb vlefshme pa nijet. <strong>Ib\u00ebn Rexhepi <\/strong>thot\u00eb se: \u201c\u00c7do pun\u00eb e kryer nga njeriu varet t\u00ebr\u00ebsisht nga nijeti i tij. N\u00eb baz\u00eb t\u00eb tij mund t\u00eb gjykojm\u00eb n\u00ebse puna \u00ebsht\u00eb e sakt\u00eb ose e gabuar, apo n\u00ebse ai person meriton shp\u00ebrblim apo d\u00ebnim\u201d.<\/p>\n<p>Fukahat\u00eb nuk pajtohen n\u00eb \u00e7\u00ebshtjen e nijetit, se: a \u00ebsht\u00eb prej kushteve t\u00eb abdesit apo jo?<\/p>\n<ol>\n<li>a)\u00a0\u00a0Medhhebi Hanefi<a href=\"#_ftn3\" name=\"_ftnref3\">[3]: Nijeti \u00ebsht\u00eb sunet n\u00eb pastrimin q\u00eb b\u00ebhet p\u00ebr abdes dhe gus\u00ebl. Nd\u00ebrsa nijeti \u00ebsht\u00eb kusht p\u00ebr tejemumin.<\/a><\/li>\n<li>b)\u00a0Nijeti \u00ebsht\u00eb kusht p\u00ebr past\u00ebrtin\u00eb qoft\u00eb p\u00ebr abdes, gusul apo tejemum. Ky \u00ebsht\u00eb medhhebi i Malikive,<a href=\"#_ftn4\" name=\"_ftnref4\">[4] Shafive<\/a><a href=\"#_ftn5\" name=\"_ftnref5\">[5] dhe Hanbelive<\/a><a href=\"#_ftn6\" name=\"_ftnref6\">[6] dhe ky \u00ebsht\u00eb mendim i sakt\u00eb. <\/a><\/li>\n<\/ol>\n<p><strong>Vendi i nijetit:<\/strong><\/p>\n<p>Fukahat\u00eb kan\u00eb r\u00ebn\u00eb n\u00eb mospajtim se ku \u00ebsht\u00eb vendi i nijetit.<a href=\"#_ftn7\" name=\"_ftnref7\">[7]<\/a><\/p>\n<ol>\n<li><a href=\"#_ftn8\" name=\"_ftnref8\">a)\u00a0\u00a0Shumica e fukahav<\/a>e thon\u00eb se vendi i nijetit \u00ebsht\u00eb zemra .<\/li>\n<li>b)\u00a0Vendi i saj \u00ebsht\u00eb n\u00eb tru, ky \u00ebsht\u00eb transmetim nga imam Ahmedi dhe thuhet\u00a0se \u00ebsht\u00eb mendim i Ebu Hanifes.<\/li>\n<li>c)\u00a0 Vendi i p\u00ebrbashk\u00ebt mes kok\u00ebs dhe zemr\u00ebs.<\/li>\n<\/ol>\n<p><strong>Llojet e nijetit : <\/strong><\/p>\n<p>Pasi kjo tem\u00eb ka t\u00eb b\u00ebj\u00eb me shkenc\u00ebn e fikhut\u00a0ne do t\u00eb ndalemi n\u00eb at\u00eb q\u00eb kan\u00eb p\u00ebrmendur vet\u00ebm fukahat\u00eb. <strong>Lloji i par\u00eb: <\/strong>Nijeti praktik prezent, kemi si q\u00ebllim nijetin q\u00eb b\u00ebhet n\u00eb fillim t\u00eb adhurimit, si nijeti p\u00ebr abdes, namaz, agj\u00ebrim etj. <strong>Lloji i dyt\u00eb: <\/strong>Nijeti teorik q\u00eb nuk \u00ebsht\u00eb prezent, kem si q\u00ebllim kur njeriu \u00ebsht\u00eb duke kryer ndonj\u00eb ibadet, por gjat\u00eb kryerjes ka harruar nijetin, Sheriati gjykon p\u00ebr sakt\u00ebsin\u00eb e vepr\u00ebs s\u00eb tij, duke u bazuar n\u00eb esenc\u00eb sipas nijetit praktik t\u00eb p\u00ebrmendur n\u00eb llojin e par\u00eb.<\/p>\n<p><strong>Nijeti haptazi:<\/strong><\/p>\n<p>Meq\u00eb vendi i nijetit tek fukahat\u00eb \u00ebsht\u00eb zemra ata kan\u00eb r\u00ebn\u00eb n\u00eb mos-pajtim, se a b\u00ebhet haptazi, me z\u00eb, me gjuh\u00eb apo jo.<\/p>\n<ol>\n<li>a)\u00a0\u00a0Nuk \u00ebsht\u00eb e lejuar t\u00eb shqiptohet dhe p\u00ebr k\u00ebt\u00eb kan\u00eb p\u00ebrmendur ixhma (konsensus).<a href=\"#_ftn9\" name=\"_ftnref9\">[8] Disa kan\u00eb ve\u00e7uar Haxhin.<\/a><a href=\"#_ftn10\" name=\"_ftnref10\">[9] <\/a><\/li>\n<li>b)\u00a0\u00a0T\u00eb shqiptuarit e nijetit \u00ebsht\u00eb i p\u00eblqyer, kjo \u00ebsht\u00eb th\u00ebnie tek hanefit<a name=\"_ftnref11\"><\/a>\u00eb<a href=\"#_ftn11\" name=\"_ftnref11\">[10] dhe shafit\u00eb.<\/a><a href=\"#_ftn12\" name=\"_ftnref12\">[11] <\/a><\/li>\n<\/ol>\n<p>Kan\u00eb ra n\u00eb mospajtim n\u00eb shqiptimin e tij n\u00eb vetvete\u00a0(pa z\u00eb).<\/p>\n<ol>\n<li>a)\u00a0Nuk lejohet, kjo \u00ebsht\u00eb n\u00eb tekstet tek imam Ahmedi.<a href=\"#_ftn13\" name=\"_ftnref13\">[12] <\/a><\/li>\n<li>b)\u00a0P\u00eblqehet t\u00eb shqiptuarit n\u00eb vetvete, pa z\u00eb, kan\u00eb th\u00ebn\u00eb\u00a0dijetar\u00ebt e vonsh\u00ebm nga hanbelit.<a href=\"#_ftn14\" name=\"_ftnref14\">[13] <\/a><strong>Ib\u00ebn Tejmije <\/strong>thot\u00eb: \u201cT\u00eb gjith\u00eb imam\u00ebt kan\u00eb r\u00ebn\u00eb n\u00eb pajtim, se nuk \u00ebsht\u00eb e lejuar t\u00eb b\u00ebhet nijeti haptazi me z\u00eb\u2026\u201d.<a href=\"#_ftn15\" name=\"_ftnref15\">[14] Nijeti haptazi me z\u00eb nuk lejohet e as q\u00eb ve\u00e7ohet p\u00ebr ihramin, sepse ai q\u00eb vesh ihramin nuk thot\u00eb: b\u00ebra nijet ta vesh k\u00ebt\u00eb ihr<\/a>am p\u00ebr k\u00ebt\u00eb haxh&#8230;, sepse kjo nuk \u00ebsht\u00eb p\u00ebrmendur, as n\u00eb hadith t\u00eb v\u00ebrtet\u00eb, as n\u00eb t\u00eb dob\u00ebt.\u00a0 Nd\u00ebrsa p\u00ebr sa i p\u00ebrket telbijes gjat\u00eb ihramit ajo nuk \u00ebsht\u00eb nijet haptazi me z\u00eb ajo \u00ebsht\u00eb n\u00eb vend t\u00eb tekbirit p\u00ebr namaz. Kjo vlen edhe p\u00ebr nijetin pa z\u00eb n\u00eb vetvete, sepse nuk ka argument q\u00eb Pejgamberi paqja dhe m\u00ebshira e Allahut qoft\u00eb mbi te apo dikush nga shok\u00ebt e tij e kan\u00eb th\u00ebn\u00eb.<\/li>\n<\/ol>\n<p><strong>Urt\u00ebsia e legjislacionit t\u00eb nijetit: <\/strong>\u00cbsht\u00eb p\u00ebrmendur n\u00eb Mevahib Xhelijl p\u00ebr urt\u00ebsin\u00eb e legjislacionit t\u00eb nijetit: Urt\u00ebsia \u00ebsht\u00eb\u00a0 &#8211; Allahu e di m\u00eb s\u00eb miri \u2013 T\u00eb ve\u00e7uarit e ibadetit nga adeti, t\u00eb ve\u00e7uarit e asaj q\u00eb \u00ebsht\u00eb p\u00ebr Allah dhe nuk \u00ebsht\u00eb, t\u00eb ve\u00e7uarit shkall\u00ebt e ibadeteve dhe shp\u00ebrblimet q\u00eb meriton robi, p\u00ebr t\u00eb dal\u00eb\u00a0n\u00eb shesh madh\u00ebshtia e Allahut t\u00eb madh\u00ebrish\u00ebm.
